On a construction site, which of these people is a « travailleur » (worker) under the LSST?

  1. A A foreman employed by the contractor to represent it in dealings with the workers
  2. B A manager hired by the company to run all of its operations
  3. C An apprentice who works without pay under an apprenticeship contract
  4. D A site superintendent employed by the contractor to supervise the crews

  1. A Yes, premises provided to workers for meals are part of the site
  2. B No, the definition only covers places where construction work is actually carried out

  4. D Yes, but only if the maître d’œuvre personally owns the trailer

Question 3

Under the LSST definition, who is the « maître d’œuvre » of a construction site?

  1. A The CNESST inspector appointed to monitor the progress of the work on the site
  2. B The health and safety representative designated by the workers present on the site
  3. C The subcontractor whose work makes up the largest share of the contract
  4. D The owner, or the person who is responsible for carrying out all the work on the site
Answer

Answer: D — The owner, or the person who is responsible for carrying out all the work on the site

The maître d’œuvre is the owner or the person responsible for carrying out all of the work. A subcontractor who performs only part of the work does not fit this definition.

Question 4

A contractor supplies harnesses to its workers and concludes it no longer needs to try to remove the fall hazard. What does the LSST say?

  1. A Protective equipment does not reduce the effort to eliminate the hazard at its source
  2. B Protective equipment relieves the employer of removing the hazard as soon as workers wear it
  3. C Elimination at the source is only required if a CNESST inspector orders it in writing
  4. D Elimination at the source only applies to chemical risks, not fall risks
Answer

Answer: A — Protective equipment does not reduce the effort to eliminate the hazard at its source

Individual or collective protective equipment must not reduce in any way the efforts to eliminate hazards at the source. Elimination at the source is the very purpose of the Act.

Question 5

A contractor sets up a trailer on the site that the employer makes available to workers only for meals and administrative work. What does the Code say about this trailer?

  1. A It applies in full, as on the rest of the site.
  2. B It applies only if one of its provisions formally prescribes it.
  3. C It never applies, whatever the provision involved.
  4. D It applies only when more than 10 workers are in it at the same time.
Answer

Answer: B — It applies only if one of its provisions formally prescribes it.

The Code applies to all work on a site, except premises used for administration, lodging, meals or recreation, where it applies only if a provision formally prescribes it. So it is neither "always" nor "never".

Question 6

A maître d'œuvre plans a site (not a site of major importance) lasting three weeks. When must it send the CNESST the written closing notice?

  1. A Within 10 days after the end of the work.
  2. B At least 10 days before the planned end of the work, as for a long-duration site.
  3. C At least 6 hours before the work starts.
  4. D At least 10 days before activities begin.
Answer

Answer: D — At least 10 days before activities begin.

For a site lasting one month or less, the closing notice has the same deadline as the opening notice: at least 10 days before activities begin. The "10 days before the planned end" rule is for longer sites.

  2. B The CNESST must first determine which employer is at fault before compensating
  3. C The right to compensation is recognized only if the subcontractor committed a serious fault

Answer

The CNESST sets the classification units annually by regulation and groups them into sectors. It is neither the employer's choice nor decided claim by claim.

  2. B Retire immediately with a replacement pension paid by the CNESST
