Speeding in Quebec: how much is the fine, and how many points?
How the fine is calculated, the demerit point table, and what changes for excessive speeding.
Short answer: the fine is $30, plus $10 to $30 for each full 5 km/h over the limit, depending on how far over you were. Demerit points start at 11 km/h over (1 point) and reach 9 points for 81 to 100 km/h over. The fine is doubled in a work zone, in a school zone during the school period, and for excessive speeding, which also brings an immediate 7-day licence suspension.
How the fine is calculated
The Code de la sécurité routière (Quebec’s Highway Safety Code) sets the fine at $30, plus an amount for each full 5 km/h over the speed limit. The amount per increment depends on the total excess (s. 516):
| Speed over the limit | Amount per full 5 km/h |
|---|---|
| 1 to 20 km/h | $10 |
| 21 to 30 km/h | $15 |
| 31 to 45 km/h | $20 |
| 46 to 60 km/h | $25 |
| 61 km/h or more | $30 |
Examples given by the Government of Québec:
- 70 km/h in a 50 km/h zone: $30 + 4 increments × $10 = $70;
- 95 km/h in a 70 km/h zone: $30 + 5 increments × $15 = $105;
- 125 km/h in a 90 km/h zone: $30 + 7 increments × $20 = $170.
These are the fine amounts only: some fees may be added on the ticket (Québec.ca, “Speed limits”).
Demerit points by speed
After a conviction, the points added to your record depend on how far over the limit you were (Regulation respecting demerit points, Schedule, item 6):
| Speed over the limit | Points |
|---|---|
| 11 to 20 km/h | 1 |
| 21 to 30 km/h | 2 |
| 31 to 45 km/h | 3 |
| 46 to 60 km/h | 5 |
| 61 to 80 km/h | 7 |
| 81 to 100 km/h | 9 |
| More than 100 km/h | 12, plus 3 for each further full 20 km/h above an excess of 100 km/h |
The table gives no points for 10 km/h over or less, but the fine applies from the first km/h.
Excessive speeding
The Code is tougher in three situations (ss. 328.1 and 516.1):
- 40 km/h or more over the limit in a zone of 60 km/h or less;
- 50 km/h or more over in a zone above 60 km/h and up to 90 km/h;
- 60 km/h or more over in a zone of 100 km/h and up.
What happens then:
- Immediate 7-day licence suspension, imposed by the police officer on behalf of the SAAQ. It becomes 30 days if the person was convicted of such an excess in the previous 10 years, and 60 days if they were convicted more than once of excessive speeding in a zone of 60 km/h or less (s. 328.1).
- Double fine; it is tripled for someone with more than two convictions for excessive speeding in the previous 10 years (s. 516.1).
- Possible 30-day vehicle seizure for a repeat offence in a zone of 60 km/h or less within 10 years (s. 328.2).
- More points (Regulation respecting demerit points, Schedule, items 6.1 to 6.3):
| Speed over the limit | Zone of 60 km/h or less | Zone above 60 up to 90 km/h | Zone of 100 km/h and up |
|---|---|---|---|
| 40 to 45 km/h | 6 | — | — |
| 46 to 60 km/h | 10 | 10 (from 50 km/h) | 10 (at 60 km/h) |
| 61 to 80 km/h | 14 | 14 | 14 |
| 81 to 100 km/h | 18 | 18 | 18 |
| More than 100 km/h | 24, plus 6 for each further full 20 km/h above an excess of 100 km/h | ||
Government of Québec example: 90 km/h in a 50 km/h zone means a $190 fine, doubled to $380.
Work zones and school zones: double fines
- Work zone. Going over the limit on the roadwork signs doubles the section 516 fine for an excess of up to 39 km/h in a zone of 60 km/h or less, up to 49 km/h in a zone above 60 up to 90 km/h, and up to 59 km/h in a zone above 90 km/h (ss. 303.2 and 516, second paragraph). Beyond that, the excessive speeding rules apply.
- School zone. During the school period set by regulation, going 39 km/h or less over the limit in a school zone means a double fine (s. 516.2). Since the limit there is at most 50 km/h (s. 329.1), 40 km/h or more over counts as excessive speeding.
Reckless speed
Even under the limit, any speed likely to endanger people’s lives or safety or property is prohibited (s. 327). It carries 4 demerit points (Regulation, Schedule, item 5) and an immediate 7-day licence suspension, raised to 30 days after a conviction for the same offence in the previous 10 years (s. 327.1).
How many points before you lose your licence?
The SAAQ revokes a driver’s licence when the points on record reach the threshold for the driver’s age: 8 points under 23, 12 points at 23 or 24, and 15 points at 25 and over (Code, s. 185; Regulation, s. 5). A first revocation lasts at least 3 months (s. 185). For a learner or probationary licence holder, the threshold is 4 points (Regulation, s. 5.1).
Key points for the test
- Fine: $30 plus an amount for each full 5 km/h over the limit.
- Points: 1 (11 to 20 km/h over), 2 (21 to 30), 3 (31 to 45), 5 (46 to 60).
- Excessive speeding (40, 50 or 60 km/h over depending on the zone): immediate 7-day suspension and a double fine.
- Work zones and school zones during the school period: double fine.
